Suit Filed by Man with Mesothelioma

Thursday, April 23rd, 2009

A suit has been filed in Madison County against 46 corporations by a man claiming that he was exposed to asbestos while working for Heat & Frost Union.

The man was employed as an insulator at various locations throughout Indiana and was recently diagnosed with mesothelioma.

Victim’s Claims

Herschel Belt claims he was exposed to and inhaled asbestos fibers that contaminated the products he was working with and around.

The complaint says that Belt’s absorption of the asbestos was preventable and foreseeable and the defendants should have known that the products that their employee’s were working with were harmful.

Asbestos Used in Products

Belt also claims in the suit that the defendants used products containing asbestos when other alternatives were available.

According to the suit, the defendants also failed to inform their employees of hygiene practices designed to reduce the amount of asbestos that is taken home.

“Plaintiff has been caused to suffer damages in the form of impaired ability to recover against defendants and lost or reduced compensation from other potentially liable parties in this litigation,” says the complaint.

Seeking Compensation

Belt is seeking compensation for his medical treatment, pain and mental anguish and loss of employment.

He is reportedly seeking at least $550,000 in damages for negligence and conspiracy.
